  2. Criminal trespass is a crime in which a person knowingly enters or remains unlawfully in a building or upon real property12. There are three degrees of criminal trespass, with the first degree being the most severe3. The degrees are defined as follows:
    • Criminal trespass in the first degree: when a person knowingly enters or remains unlawfully in a building, and when, in the course of committing such crime, he possesses, or knows that another participant in the crime possesses, an explosive or a deadly weapon.
    • Criminal trespass in the second degree: when a person knowingly enters or remains unlawfully in a building.
    • Criminal trespass in the third degree: when a person knowingly enters or remains unlawfully in a building or upon real property which is fenced or otherwise enclosed in a manner designed to exclude intruders.
