A temporary food service permit is required for outdoor food festivals, pancake breakfasts, and other events where food is served to the public on a temporary basis. In order to obtain a permit, complete the Application for Temporary Food Events and submit the application form and fee to the WCHD at least seven days prior to the event. Fees and requirements for Temporary Food Service Permits are based on risk type. Your risk type and the corresponding fee are determined by the menu items and the amount of food preparation to be done on-site as set forth on the fee page of the Brochure. All vendors applying to serve potentially hazardous foods that require extensive preparation and long-term cooking (pig roasts, smoked meat) must also submit a Hazard Analysis and Critical Control Points (HACCP) plan. Those responsible for planning and coordinating a temporary food event must file an Event Coordinator Application with the WCHD containing details about the event and an event sketch showing the names and locations of vendors, the food booth set up, and the locations of facilities like restrooms, cooking and storage areas and solid waste disposal.

Before constructing or remodeling a food service establishment, a proposal shall be submitted to the Division of Environmental Health at the WCHD. Use the Food Establishment checklist to organize all the required documentation for a plan review. Proposals may be hand delivered or mailed. Plan review payments must be made at the time of submission and can be made in person, over the phone or electronically using GovPay or 1-888-604-7888, use Pay Code Location #7078. Drawings submitted are not required to be from an architect however drawings should be a readable size and legible. Drawings should include an equipment layout with an equipment list keyed to the drawing. Mechanical, plumbing, and electrical drawings should be included with the proposal. A room finish schedule is required. If the drawings do not include a room finish schedule use the Food Establishment Room Finish Schedule found below. Proposals are reviewed in the order in which they are received. Generally, the initial plan review process will be completed in 10-14 days. If an operation requires a quicker review time an expedited fee (twice the usual fee) can be paid and the initial review will be completed in 7 days. As a project nears completion the operator shall call to schedule an inspection. New facilities are required to have an inspection prior to operating. Existing facilities that remodel or make changes are required to be inspected prior to operating new equipment or occupying new areas of the facility. After a facility has a satisfactory inspection a Food Establishment Permit may be issued.

If a food establishment wishes to implement a special process as defined in § 114.002 or if circumstances exist which make it impractical to achieve full compliance with the requirements of this chapter, an applicant may seek a variance from the Health Authority as follows: (1) Such requests shall be made in writing, and include a Hazard Analysis Critical Control Point Plan (HACCP) if required, and all pertinent data and information, as stipulated in applicable code (s), to support the requested waiver of the requirements of this chapter as being consistent with the responsibility of the Health Authority to protect and provide for the health, safety, and general welfare of the people of the county and of other affected communities. (2) The Health Authority shall review variance requests and shall notify the applicant in writing of its decision to either grant or deny the variance within ten business days of receipt of the variance request provided all conditions of this section are met including payment of fee (see Appendix A ), and submission of supporting data. (3) The fee associated with the variance request process is included in Appendix A. Variance fees are non-refundable. (B) Exceptions to variance. Reduced oxygen packaging utilizing sous vide or the cook/chill method do not require a variance.
